This Privacy Policy is intended to demonstrate the commitment of VERSIO TECNOLOGIA LTDA., a private legal entity registered under CNPJ No. 59.990.681/0001-25, with its head office at Rua Dr. Renato Paes de Barros, No. 618, Suite 01, Itaim Bibi, São Paulo/SP, ZIP code 04.530-000, herein represented in accordance with its constitutive documents, hereinafter referred to as “VERSIO”, to the protection of its users' personal data.
It covers both data that directly identifies an individual and any other information provided to VERSIO.
This document establishes guidelines, controls and responsibilities regarding the use and sharing of confidential information within the scope of VERSIO's activities, whether professional, contractual, or arising from any other legal transactions entered into, or that may be entered into, in accordance with the laws in force, in particular Law No. 13.709/2018 and its subsequent amendments (the “Brazilian General Data Protection Law” or “LGPD”).
a) Confidential Information: Any and all information, data, document, project, report, contract, contractual draft, correspondence, technical specification or material, regardless of its format — written, oral, electronic, visual, digital or any other medium — that is not publicly known and that has been disclosed, transmitted, accessed or in any way made available to VERSIO, or by it to authorized third parties. This definition includes, but is not limited to, financial, accounting, legal, strategic, technical, operational, commercial, economic, marketing, engineering, programming, product development, system architecture, process flow, business model, expansion plan, ongoing negotiation, customer, supplier and partner data, as well as any other knowledge, methods, procedures, formulas, source code, algorithms, databases and know-how, whether technical or non-technical in nature.
b) Personal Data: Information related to an identified or identifiable natural person, as defined in the Brazilian General Data Protection Law (LGPD).
c) Sensitive Data: Information related to racial or ethnic origin, religious beliefs, political opinions, genetic or biometric data, health, or sexual orientation.
d) Anonymization: The use of reasonable technical means available at the time of processing, by which data loses the possibility of being directly or indirectly associated with an individual.
e) Purpose: The reason why the personal data of the data subject is processed.
f) User: The person to whom the personal data being processed refers.
In order for VERSIO to process personal data, it is essential that certain information be provided directly by the USER. Such information may include, but is not limited to, registration data such as name, CNPJ (Brazilian corporate tax ID), address and telephone; professional data such as job title, role and employer; as well as information collected through cookies, such as usage history and interaction with the services.
Within VERSIO's system, data provided by the USER will be processed and stored only for the period strictly necessary to fulfill the purposes for which it was collected, or for the time required to comply with legal and regulatory obligations, contractual obligations undertaken, as well as to ensure the exercise of VERSIO's rights in administrative, arbitration or judicial proceedings, or in any other situations provided for by the Brazilian General Data Protection Law (Law No. 13.709/2018).
Once the storage period has elapsed or the purposes that justified the processing have been exhausted, VERSIO will proceed with the definitive and secure deletion of personal data, in compliance with applicable technical standards.
Credit or debit card numbers eventually provided by the USER are used exclusively for carrying out financial transactions related to the contracted services, and are under no circumstances stored in VERSIO's databases.
Personal data and other information collected may be used by VERSIO in order to enable access, proper use and safe navigation of the services offered, including registration processing, USER authentication and account management, ensuring that only duly authorized individuals are able to enjoy the available functionalities.
In addition, such data may be used to carry out internal performance analyses, quality assessments and continuous improvement of the services, as well as for the development, training and refinement of artificial intelligence models, always with the aim of providing a more efficient, personalized experience that is suited to the needs of each USER.
Provision of services
The personal data collected may be shared with third parties exclusively to enable the provision of the services offered by VERSIO. This includes suppliers, service providers and partners that act internally on behalf of VERSIO, allowing the proper operation, maintenance and continuous improvement of the services. Sharing only takes place to the extent necessary for such third parties to carry out essential activities, ensuring confidentiality and protection of the information processed.
Compliance with legal obligations and protection of rights
VERSIO may share personal data when necessary to comply with legal, regulatory or judicial obligations, including compliance with applicable laws or regulations, participation in judicial, arbitration or administrative proceedings, as well as to protect, exercise or defend the rights, security, property and interests of VERSIO, its users or third parties. Such sharing may take place with public authorities or competent entities, always in compliance with applicable law.
Corporate transactions
Data may be shared in the context of corporate transactions such as mergers, acquisitions, reorganizations, total or partial sales of assets, or any commercial transactions involving VERSIO. In such situations, personal information may be transferred to the successor company, potential successor or its employees, exclusively to the extent necessary to complete the transaction, ensuring the continuity of secure and adequate processing of the data.
User Consent
Personal data may be shared when there is express consent from the USER, observing the limits and purposes previously informed. Consent will allow certain information to be made available to specific third parties for specific purposes, ensuring transparency and USER control over the processing of their data.
Integration services
VERSIO may use access analysis and monitoring tools, with the purpose of collecting metrics on the use of the platform, USER behavior and service performance.
The USER may request access to their personal data and may learn what information is being processed by VERSIO, as well as obtain a copy of such data, when applicable.
The right to request the update or correction of incomplete, inaccurate or outdated personal data is also guaranteed, ensuring that the information processed adequately reflects the data subject's reality.
The data subject has the right to request the anonymization, blocking or deletion of unnecessary or excessive personal data, or data processed in non-compliance with applicable legislation.
Likewise, the data subject may request the deletion of their personal data when processing is based exclusively on consent, and may revoke such consent at any time, without prejudice to the lawfulness of processing carried out prior to revocation.
The USER also has the right to oppose, at any time, the processing of their personal data when based on legal grounds other than consent, including, among other situations, VERSIO's legitimate interest or compliance with a legal or regulatory obligation, except where processing is necessary to comply with legal or regulatory obligations.
In addition, the data subject has the right to data portability, and may request that their personal information be transferred to another service provider or controller, when technically feasible, in compliance with applicable law.
The data subject is also guaranteed the right to file a complaint with the competent data protection authority in case of doubts or dissatisfaction regarding the processing of their personal data.
All rights mentioned may be exercised by the USER through direct contact with VERSIO, via the communication channels made available, and VERSIO undertakes to provide a response within a reasonable period and in accordance with applicable legislation, ensuring transparency, security and respect for the privacy of the personal data of its Users.
Personal data collected by VERSIO is stored in secure, controlled environments protected by appropriate technical, administrative and organizational measures, in order to prevent unauthorized access, loss, alteration, undue disclosure or any form of inadequate processing.
Storage is carried out in compliance with applicable legislation regarding personal data protection, ensuring that information is treated with confidentiality, integrity and security.
Data will be retained for the time necessary to fulfill the purposes for which it was collected, as well as to comply with legal, regulatory or contractual obligations.
When data is no longer necessary for such purposes, or upon request from the data subject, it may be deleted, anonymized or rendered inaccessible in a secure manner, in compliance with internal procedures and applicable legislation.
VERSIO undertakes to periodically review its storage and security processes, adopting good data protection practices, ensuring that the processing of information is always compatible with the declared purposes and providing transparency and trust to the USER regarding the use of their personal data.
This Privacy Policy constitutes the most up-to-date and current version of the rules applicable to the processing of personal data carried out by VERSIO.
At any time, VERSIO may amend, supplement or revise the content of this Policy, in accordance with institutional purposes, operational needs, or to ensure adequacy and compliance with applicable legislation. It is the USER's responsibility to regularly consult the most up-to-date version made available on VERSIO's website in order to remain informed of any changes.
In case of doubts, questions or requests related to this Privacy Policy or the processing of personal data, the USER may contact VERSIO directly through the customer service channels made available.
This Privacy Policy, as well as any relationships or actions arising from its content, shall be governed by Brazilian law.
To resolve any disputes or litigation related to this Policy, the venue of the District of São Paulo, State of São Paulo, is hereby elected, with express waiver of any other, however privileged it may be.
